Do I have a case in small claims court with nothing in writing and nothing signed?
My mom died in 1997 and after she passed away, my father put their house in my name because I am the executor of their estate. He wanted the house in my name in case he got sick or something happened to him. My father passed in 2007 and I had the deed to the house. I have 5 siblings and we decided to sell the house to one of my brothers. The deal was that he pay $20,000 for the house, and one of my sisters gave up her shares. So, my brother (and his wife) is to pay $335 a month to each of the siblings that are left to receive their share. Each sibling gets paid $335 a month for one year until we have all been paid (5 years time). When they moved into the house, I signed the deed over to them, on the notion that they would pay everyone. The only paper that was drawn up states who gets paid when. Nothing was signed by me, my brother or his wife, and he has the deed in his name.
Now, here is the problem. The first two siblings have been paid, but now my brother and his wife have fallen on hard times and have not been able to pay (right now, they are supposed to be paying me and then they have two more siblings to pay). If I take them to small claims court, do you think I have a case considering I didn’t get anything in writing and the deed is in his name already and he has possession of the deed?

The prior proof of payments paid to you will enforce your verbal agreement should you choose to take this to court. I would try and settle for interest to be tacked on before taking it to court, it’s not going to help you getting paid any faster if they Truly fallen on hard times. You can’t get blood from a stone.

I don’t think you can work with them, but there are karaoke versions on Youtube, just the music with vocals removed. Some are better than others… you could also try uploading the mp3 of Drive into Audacity, split the stereo tracks, invert the bottom one, set both to mono and try to see if the vocals are removed leaving only the music.

Why is it that so many atheists are having difficulties challenging Peter Murphy's statements below?
The question that arises about nature is: is it a creation, eternal to nature, or an accident within nature. The Deist will maintain that it is a creation, but Deists will differ as to degree of involvement on the part of the Creator in the process. The atheist will counter that it is either eternal, or accidental. The final resolution of this problem will eventually be up to science to settle.

To begin, let us look at nature as an ever changing and shifting painting. Science attempts to understand what the paint and canvass is composed of, the relationship of the individual paints, and the brushstrokes that are involved in the final product. But, what about the painter? If one admits that nature is similar to a painting, than it is not too far a leap to conclude that a painter exists, or at least existed at one time.

The atheist continually resorts to the logical fallacy known as argumentum ad verecundiam (appeal to modesty) when dealing with Deists or even theists. The appeal here is to science as an authority which cannot be challenged. Unfortunately, this appeal is plagued by its own problems.

First of all, science makes no claims about God one way or another, so it is not the scientists who are for the most part claiming God does not exist on the grounds that there is a lack of evidence, but the scientific layman asserting it.

Second, science for all its great accomplishments is still in the infant stage, there is much about nature it simply does not know, even on this planet. So to conclude that a discipline, which has limitations here and now, somehow can conclude that something beyond its immediate ability to study is the final word, is logically speaking, a fallacy.

Science itself is somewhat bias as well. It suffers from nearsightedness; what it cannot observe directly or indirectly, it ignores. Things like memory may have a basis in biology, but is it safe to conclude that only biology is at work here? No one has ever seen an emotion, or a memory; yet they exist. So it is not far-fetched to conclude that there is more to nature than what we observe in our own limited corner of it. Science has only touched the tip of the scientific iceberg — as such, science cannot be used to dismiss the idea that a God may exist. If one cannot truly understand a grain of sand, then one cannot understand the beach.

So where does the Deist stand? The Deist recognizes the limitations of belief; but still possesses the courage to believe. The belief in God in no more illogical than the belief in Extraterrestrial life forms. Nevertheless, despite the present lack of evidence for E.T. life forms, few scientists would outright dismiss them. If one accepts that E.T. life forms may exist, then one must conclude that such life forms could be far superior to us in knowledge and power — if so, then God is in a sense, could be regarded as an E.T. life form as well. Or more accurately an Extradimensional life form. Such a being, or beings, cannot be dismissed as impossibilities.

The atheist demands that the Deist, or theist, provide evidence for the existence of God. They continually resort to logical fallacies of their own, for example, a common one is the Petitio principii (begging the question) fallacy; it goes something like this: there is no God because we find no evidence of God in nature. But is this true? No. We presently do not know enough about nature to make such a conclusion, eventually, the possibility that there is a God could be proven. The atheist has no evidence that the universe is eternal or accidental; they are assuming that scientific speculation somehow equals scientific fact. Obviously there is a great gap between speculation and fact to the rational mind.

We have the painting, but to dismiss that there is a painter is illogical, unless there is evidence that it is either an eternal painting or an accident. So far all science has offered is speculation based on drawing inferences from the available data [which is far from complete]; nevertheless, since the evidence is not complete, nor fully understood, sweeping generalizations by atheist on what exists and does not exist are groundless.

Atheists like to shift the burden of proof from themselves to their debating opponents; in short, the believer in God must prove God, but the atheist will not defend his position that the universe is either eternal or accidental. Often this tactic works, the believer will then try to make an argument for God, only to have the atheist demand that the believer first define God in some clear manner. Once the believer makes this mistake, he loses the debate. We are still in the process of understanding the painting, so trying to define the painter is doomed to failure; the believer must recognize this tactic and avoid it. Deists should feel free to openly state that there is absolutely no evidence against a Creator being, or a Creation, and that all skeptics have to offer is scientific speculatio
on very limited data. Deists believe there is something more; that is not unreasonable, it is very much human and rational. That "more" is God. Deists are willing to wait for the answer and are keeping an open mind on the matter; it is the atheists, who fear waiting. Simply put there is no evidence against God, nor is there evidence against a Creation [design]. The burden of proof does not lie on the open mind, but on the closed dogmatic mind which assumes that we already know all there is to know

The smartest people in this section as of right now are agnostics.

Until we advance, say, 1000 years from now, we may not know how to test the super natural being like a god. Therefore, believing, or not believing is completely useless, until we can prove something like this exists.

I fully support what has been said, and to say a god doesn’t exists or exists is really stupid, because we as a species aren’t advanced enough to come to a logical conclusion.

P.S. A lot of the things written in this are really… horrible. I only agree with the fact that it’s impossible to prove or disprove the existence of a god.

I read through most of the above, and must protest to the assumption that atheists automatically challenge the views of theists and deists.

Actually, I believe deists have some pretty strong arguments going for them. Most deists I’ve met make a lot of sense since they tend not to be pretentious and claim they have all the answers. I always thought that deists and atheists got along, in general, better than many other groups.

Edit: I agree with Michael H, it is impossible to prove or disprove the existence of divine entities like gods. This is in part why I am repelled from religions that claim to know everything and are 100% positive in every minute detail of their beliefs. I find that agnostics and deists usually have the most honest and logical arguments.

I’ll challenge this right here. The only way for a theist or deist to have a chance in this debate is to leave the terms undefined. If you can’t define what the painter is, it doesn’t make much sense for you to use it as an analogy. That’s just intellectually dishonest.

I do have an open mind. I admit there may be something more, but unless you can support any notion of this with evidence… I’m under no obligation to believe you unless I take it as a matter of faith. You can’t do this because you can’t even define what it is you’re trying to prove.

Most theists that I communicate with believe in a loving and all-powerful God who knows all and they assume that if anyone does not believe the same then they don’t believe in God. They have no capacity for seeing God in another way. I see Nature as God, but I don’t look for a fairy tale explanation of its origin. God has no love but it does have a bond in that we are all a part of it. It is not all-powerful either; it has limitations on its spread of life. As for God’s omniscience, there is not a central brain that runs everything or is conscious of everything.

The party has no fear to criticize our social and domestic spending policies but when it comes to our extremely flawed foreign policy it’s hands off for them?

Last night, Obama whined that the Republican party opposed everything he did. "Opposing everything is not the way to lead!" Well, you make a good point. Obama had no basis to whine. We simply oppose what we disagree with. We don’t oppose him merely to make political points. If he would acknowledge our support of his foreign policy, slow, ponderous and timid as it may be, he could recognize this fact.

In response to your question though, it is because, for the most part, we agree with it. Don’t want to be the ‘world police’? Fine. We’ll pull back and let nations rebuild their own armies. Let’s let Germany, Japan and every other nation devote their resources to build up their military strength so that they can defend themselves. Or, we can be the world police, allow these nations to have limited armies and maintain a relative peace. (Hard to start a war if you don’t have anything to fight with.) See? I trust the United States. I do not trust other nations.

And we are rarely ‘preemptive’. When we are, it is because thousands or tens of thousands of American lives may be at stake. Call me crazy, but I’d prefer to act before that happens.

My chances for paternal custody?
So, I have a son due to be born in late April, and recently the mother and I have had some turmoil.

A little background between her and I: There was never really a RELATIONSHIP per se… it was one of those things that happened, and the result was that we have a son on the way.

Despite the circumstance, I’m ecstatic about it; he will be my first and I already have a nursery set up, my mother (soon-to-be grandma) has a nursery at her house, I have already made arrangements with the state for child support garnishments and really, it seems most things are arranged as they should be.

The mother and myself were on very good, civil terms. We agreed that it may not be the right thing to force an incompatible relationship solely for the reason of a child. We could be effective and loving parents, even if we were not together.

Fast forward to about a week ago. She has, for some unknown reason, become very spiteful and bitter; she feels that I should let her move in with me and that I should not see other people (even though I’m not!), and that overall I’m a jerk for not wanting a relationship.

Anyways, the question at hand is… what are my chances for full paternal custody?

I’m a 28 year old recent graduate with a Biochemistry/Biotechnology degree. I have an excellent job that provides full benefits for myself and my son, I have my own place and an excellent support group of family and friends. I’m a non-smoker, no drugs, occasional drinker, and an ultra-hard worker.

My home life is fairly tame, just me and the dog with a frequent visiting of friends and family and neighbors.

Her lifestyle, on the other hand… just seems so non-conducive to raising a healthy child. She is a frequent smoker.. I even paid for her to have auricular therapy to quit while pregnant, and she lasted a whole 3 hours. She lives with some other guy who is the father of her other child, and who only lets her stay there so he doesn’t have to pay child support. He constantly threatens to kick her out, at which point she would have nowhere to go. She has never had a job in her life other than as a stripper. She is entirely unwilling to go get a job, and says the child support she will get will be enough. She didn’t even graduate high school, she drops F-bombs and cusses all the time around her 2 year old son. She asks her son to go get her cigarettes for her, and smokes in the house, right in front of him. She can’t have a bank account because she owes like $5,000 to her previous bank. She got denied government housing because of bad credit (that’s bad).

Her family is extremely narcissistic and dysfunctional, they provide no support or help for her. Hell, her Mom can’t even get her own apartment, her sister is a recovering drug addict. The only rational one in her family is her brother, and he can’t even make decisions without his family down his neck.

Grr! it’s so frustrating because I can’t exactly prove her "unfit," but I’d be damned if a court tells me to my face that my son is going to be better off with her than with me.

So, are there any fathers out there that have gone for full custody… and won?

I think you do have a good shot, especially if you hire an attorney. Perhaps the reason she is suddenly so bitter and angry is it’s getting closer to the time she will deliver and she is upset that she isn’t having this baby under ideal circumstances (i.e. a stable relationship). Anyway I’m sorry to hear you are going through this and courts are usually very difficult to persuade one to take a child away from it’s mother so you do have an uphill battle but I would definately fight for it. You didn’t mention anything about where you would place the child while you were at work so that’s another thing you need to consider before bringing your case to a judge, but all in all I do think your chances are very good. Plot: Peter Venkman, Ray Stantz, and Egon Spengler are three scientists at Columbia University in New York City. When their grant expires, the guys are fired and they go into business as a ghost extermination company called “Ghostbusters”. Their first customer is orchestra cello player Dana Barrett, who was scared out of her apartment on the 22nd floor of a high rise apartment building on Central Park West. It seems that Dana’s neighbor, Louis Tully, is also being affected by the strange happenings in the apartment building. Armed with proton guns, the Ghostbusters become wildly popular, and they are joined by Winston Zeddmore, who is looking for a job with good pay. Overzealous Environmental Protection Agency (EPA) agent Walter Peck thinks the Ghostbusters are frauds, and he has the Ghostbusters put in jail. Peck is forced to believe the Ghostbusters when New York City is put under siege by an ancient Sumerian God named Gozer the Gozerian, who is channeled through the apartment building that Dana and Louis live in, and the mayor has no choice but to let the Ghostbusters out of jail to face Gozer.
